The Confederation of African Football-CAF, has frowned at Cameroon mobile telephone service providers, MTN Cameroon for illegal use of its contents and other brand rights for commercial purpose ahead of the 2021 Africa Cup of Nations in Cameroon.
In a letter sent to MTN Cameroon early this week, CAF warned MTN’s marketing promotion department for illegally making use of its contents for personal gains ahead of the 2021 AFCON in Cameroon including CAF related advertorials on its social media handles without prior permission from the African football governing body.
“This formal notice concerns the marketing promotions of MTN Cameroon linked to the Africa Cup of Nations (The Competition) . Your draw and your advertising including the publications on your social media platforms illegally exploit intellectual property belonging to the Confederation of African Football (CAF).” A portion of the letter dated December 27, 2021, reads.
CAF in return requested MTN Cameroon to consequentially take down all CAF related contents and brand rights used in directly or indirectly promoting its brand and products ahead of the forthcoming event in Cameroon
“In particular, and without limitations, MTN Cameroon is requested to;
-Immediately remove any advertising spots, posters or publication directly or indirectly referring to the competition.

-Immediately cancel any activity or promotion directly or indirectly referring to CAF competitions.
-Immediately cease any additional action that may use the name, image, logo or any other marks directly or indirectly linked to the Competition or to CAF and for which use CAF has not provided prior written approval.”
These actions, CAF reiterated, falls in line with the organ’s full ownership of all print, audiovisual and other rights which may also fall under what could be termed Media Rights.
“CAF is the exclusive owner of all rights that may arise out of or in connection with the competition , including all the elements, composing relating to or designating the Competition , economic rights of all kinds, audiovisual recording, reproduction and broadcasting rights , multimedia rights, marketing and promotion rights as well as intellectual property rights such as trademarks rights and copyright.
No third party may, directly or indirectly use or avail themselves of all or parts of these rights and in particular, any right generally referred to as “Media Rights” of the competition without the prior express written authorization of CAF.”
The organ spelled out the warnings to MTN Cameroon while declaring MTN’s failure to respect the requested actions, will push the Confederation into taking judicial actions against the mobile telephone service providers.
“Failure to immediately comply with the content of this letter is liable to cause irreparable harm. Accordingly, CAF may act in front of any jurisdiction of competent authority, including by way of provisional or interim ‘ex porte’ measures, to obtain any redress available to preserve its rights…(.)” The organ concluded.
